Terms of Service

These terms are the supplier agreement for Schärpf Account, Schärpf software, app licences, and related services. They are between you and André Schärpf ("Schärpf"). If a specific app or a signed commercial agreement has different terms, those terms control for that app or agreement.

2. Eligibility and authority

You must be at least 18 years old, or the age of legal majority where you live, to create an account or buy a product. If you use the services for a company or other organisation, you confirm that you are authorised to act for it. Team administrators are responsible for managing members and licence assignments within their organisation.

3. Your account

Provide accurate account information, keep your sign-in methods secure, and tell Schärpf promptly if you believe an account has been compromised. You are responsible for activity performed through your account unless it resulted from a security failure attributable to Schärpf. Account access may be suspended where reasonably necessary to protect the service, investigate abuse, comply with law, or address a material breach of these terms.

4. Software and licence

Schärpf grants you a limited, non-exclusive, non-transferable licence to install and use the software and capabilities made available to your personal account or assigned to you through a team. The licence lasts for the applicable one-time licence term, subscription term, trial, or free-access period shown with the product. Ownership of the software and its intellectual property does not transfer to you.

You may not:

  • resell, sublicense, rent, or share an account or licence outside its intended user or team;
  • circumvent account, entitlement, seat, technical, or security controls;
  • copy, modify, or reverse engineer the software except where applicable law expressly permits it;
  • use the services to break the law, infringe rights, distribute malware, attack systems, or interfere with other users.

5. Purchases, subscriptions, and Polar

Polar Software, Inc. is the merchant of record and authorised reseller for purchases made through Polar Checkout. Your purchase from Polar is also subject to the Polar Buyer Terms. Polar handles payment collection, payment methods, taxes, invoices, receipts, refund processing, and chargebacks. Schärpf provides the software licence, account entitlement, product support, and fulfilment.

The checkout shows the price, currency, taxes, billing period, and renewal terms before purchase. Subscriptions renew until cancelled. You can manage or cancel a subscription through the billing portal linked from Schärpf Account or by contacting support. Cancellation normally takes effect at the end of the current billing period unless law or the checkout terms require otherwise.

Refund and withdrawal requests are assessed under applicable law, the Polar Buyer Terms, and any product-specific policy shown before purchase. Contact or Polar support with the order number. Nothing in these terms limits a mandatory consumer right, including a right of withdrawal or statutory remedy that cannot lawfully be waived.

6. Updates and service changes

Software and account features may be updated to fix defects, improve security, maintain compatibility, or change functionality. Material reductions to an active paid service will be handled in accordance with the purchase terms and applicable law. Preview, beta, or experimental features may change or end with shorter notice and should not be used for critical production work unless agreed otherwise in writing.

7. Third-party services

The services rely on third parties including WorkOS for identity, Polar for billing, Supabase for managed database infrastructure, and Render for hosting. Their availability can affect Schärpf services. Third-party products that you connect or access separately remain governed by their own terms.

8. Support and privacy

Support is available by . How personal data is handled is explained in the Privacy Notice. Business customers that need a data processing agreement or specific security commitments should contact support before deploying the service for regulated or high-risk data.

9. Statutory rights, warranty, and liability

Mandatory statutory warranty, digital-product, and consumer rights remain unaffected. Schärpf is liable without limitation for intent and gross negligence, for injury to life, body, or health, under the German Product Liability Act, and where a guarantee was expressly given. For ordinary negligence, liability is limited to the breach of a material contractual obligation and to damage that was typical and reasonably foreseeable when the agreement was made. Any further limitation applies only to the extent permitted by law.

10. Ending use

You may stop using the services at any time and may request account deletion through support. Cancelling a subscription and deleting an account are separate: cancel active subscriptions through the billing portal before requesting account deletion. Some billing, tax, security, fraud, and legal records may need to be retained after account access ends, as described in the Privacy Notice.

11. Governing law

German law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice does not remove mandatory protections of the country where you habitually live. Courts are determined by applicable law; for merchants, public-law entities, and public-law special funds, the place of business of André Schärpf is the agreed venue where legally permitted.

12. Changes and contact

These terms may be updated for legal, security, or service changes. Material changes affecting an active paid service will be notified by an appropriate channel and will not apply retroactively where the law requires consent. Questions can be sent by .
